These Terms and Conditions ("Terms") govern your access to and use of Studiology, a platform operated by Present Day Production Ltd, a company registered in England and Wales (company number 09090005, VAT number GB438945255), with its registered office at Chelmshoe House, Monk's Lodge Road, Great Maplestead, CO9 2RL, United Kingdom.
By creating an account and using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not create an account or use the Service. These Terms should be read alongside our Privacy Policy, which explains how we handle your personal information.
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. The Service is intended for individuals who are running, or actively building, a business, and is provided on a business-to-business basis. Studiology is designed for use on a desktop or laptop computer; some features may not function correctly on mobile devices.
Studiology is a hybrid business mentorship platform and operational CRM. Phase 1 is a structured, sequential educational programme of 32 modules, guided by Elgar, which must be completed in order. Phase 2 unlocks upon completion of the final module, giving you access to a live operational dashboard (the Operations Hub) to manage clients, proposals, and payments. We may add, remove, or change features of the Service at our discretion, and will use reasonable efforts to notify you of material changes.
Elgar is an artificial intelligence system, not a human being. Every AI chat surface in Studiology discloses this on-screen. Elgar's responses are generated using Anthropic's Claude API running on our own custom codebase, based on the information you provide.
Elgar is designed to help you build and run your business, but its output is generated automatically and may occasionally be incomplete, inaccurate, or unsuitable for your specific circumstances. Elgar does not provide legal, financial, tax, accounting, or other professional advice, and nothing generated by Elgar should be relied upon as such. You remain solely responsible for the decisions you make in your business, including pricing, contracts, and dealings with your own clients. Where a decision has legal or financial consequences, you should seek advice from an appropriately qualified professional.
We do not guarantee any particular business outcome, level of income, or results from using the Service. Running a business involves risks and variables entirely outside our control - your market, your clients, your own effort and execution, and general economic conditions, among others - and we accept no liability for the performance of your business, including any losses, missed opportunities, or reduced income arising from decisions made using Elgar's guidance or any other feature of the Service.
You must provide accurate information when creating your account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access to your account.
Access to the Service requires a paid subscription, billed on a recurring basis through our payment processor, Stripe. By subscribing, you authorise us to charge your chosen payment method on a recurring basis until you cancel. Prices are shown inclusive or exclusive of applicable tax as indicated at checkout; tax is calculated automatically based on your billing location. We may change our subscription prices from time to time, and will give you reasonable notice before any change takes effect for existing subscribers.
Except where required by law or expressly stated otherwise, subscription fees are non-refundable, including for partial billing periods.
We may, at our discretion, offer certain members free or discounted access for a limited period, including as part of a beta testing programme. Any such offer is personal to the member it is extended to, is not transferable, and may be withdrawn or amended by us at any time. Where a free or discounted period has a defined end date, your subscription will either end automatically or move to standard pricing at that point, as communicated to you at the time the offer was made.
You may cancel your subscription at any time via the Customer Portal linked from your Account page; cancellation takes effect at the end of your current billing period. You may also permanently delete your account and associated data at any time via the Danger Zone in your Account settings.
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have breached these Terms, misused the Service, or where required to comply with the law. We may also discontinue the Service in whole or in part, in which case we will provide reasonable notice where practicable.

You retain ownership of the business and client data you submit to the Service ("Your Content"). By submitting Your Content, you grant us a licence to host, store, process, and transmit it (including to Anthropic, as described in our Privacy Policy) solely for the purpose of providing and improving the Service to you. You are responsible for ensuring that you have the right to submit any client or third-party data you enter into the Service, and for complying with your own data protection obligations towards your clients.

The Service, including its underlying software, the 32-module curriculum, design, branding, and all associated intellectual property rights, is owned by or licensed to Present Day Production Ltd. Nothing in these Terms transfers any such intellectual property to you. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your own business purposes for as long as your subscription remains active.
The Service relies on third-party providers, including Anthropic (AI processing), Stripe (payments), Clerk (authentication), Railway (hosting), and Backblaze/Cloudflare (file storage). We are not responsible for outages, errors, or issues caused by these third-party providers that are outside our reasonable control.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or entirely secure. Nothing in these Terms excludes or limits liability for matters which cannot lawfully be excluded or limited under English law, including death or personal injury caused by our negligence, or fraud.
Studiology is a business mentorship platform and operational tool intended to support your own decision-making - it is not a guarantee of business success. You remain solely responsible for the running, management, and performance of your own business at all times, including any strategic, operational, financial, pricing, legal, or client-facing decisions, whether or not those decisions were informed by Elgar or any other part of the Service.
To the fullest extent permitted by law, our total liability to you arising out of or in connection with these Terms or your use of the Service, whether in contract, tort, or otherwise, is limited to the amount you have paid us for the Service in the 12 months preceding the event giving rise to the claim. We are not liable for any indirect, special, or consequential loss, including loss of profits, revenue, business, or data, arising from your use of the Service or reliance on any content generated by Elgar.
Without limiting the foregoing, we are not liable, under any circumstances, for how your business performs while using, or as a result of using, the Service. This includes (without limitation) any loss of clients, revenue, or opportunity, any pricing, contractual, or strategic decisions you make, and any outcome of following guidance, templates, or strategy provided through the 32 modules, the Operations Hub, or Elgar. You are solely responsible for your own business, and for evaluating whether any guidance provided through the Service is appropriate for your specific circumstances before acting on it.
You agree to indemnify and hold Present Day Production Ltd harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or Your Content, except to the extent caused by our own breach or negligence.
We process personal data in accordance with our Privacy Policy, which forms part of these Terms. Where you submit personal data about your own clients into the Service, you act as the data controller for that data and remain responsible for your own compliance with applicable data protection law.
We may update these Terms from time to time to reflect changes in the Service, our practices, or for legal reasons. We will update the "Last updated" date at the top of this page when we do, and where changes are material, we will use reasonable efforts to notify you (for example, by email or an in-app notice). Continuing to use the Service after a change takes effect means you accept the revised Terms.
These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, save that nothing in this clause affects any statutory rights you may have as a consumer or business in your own jurisdiction.
